A short confidentiality and responsible-use agreement for the private Ask PCAT beta.
1. Agreement and purpose
This Beta Tester Confidentiality and Responsible Use Agreement (the “Agreement”) is between Promotional Coaching and Training (“PCAT”) and the individual accepting below (“Tester”). PCAT is providing Tester limited access to a non-public beta version of Ask PCAT solely to evaluate the service and provide candid feedback.
2. Confidential beta information
“Confidential Information” includes all non-public information disclosed through or concerning the beta, including Ask PCAT screens, features, workflows, prompts, responses, source displays, limits, pricing, performance, and technical behavior; PCAT training materials, source collections, excerpts, organization, methods, and other proprietary content; testing instructions, development plans, defects, unreleased improvements, communications, and feedback; and information identified as confidential or reasonably understood to be non-public and confidential.
3. Tester’s confidentiality obligations
Tester will use Ask PCAT only for authorized beta testing; not copy, photograph, screenshot, screen-record, download, publish, post, forward, demonstrate, or otherwise share beta content or access without PCAT’s written permission; protect login credentials and report suspected unauthorized access, disclosure, or loss; not bypass access controls, extract source collections, reverse engineer the service, or test security outside PCAT’s instructions; and promptly delete or return beta materials when requested or when access ends.
4. Information Tester must not submit
Tester will not enter criminal justice information, active investigative information, passwords, protected personal information, or identifying information about victims, witnesses, suspects, juveniles, employees, or other individuals. Questions should use generalized or fictionalized facts whenever possible.
5. Responsible use and accuracy
Ask PCAT is a research and training support tool. It may produce incomplete, outdated, or incorrect information, misunderstand facts, omit relevant authority, or cite material that requires verification. It is not a substitute for professional judgment or independent review. Tester will not rely exclusively on Ask PCAT for an operational, enforcement, supervisory, disciplinary, legal, or policy decision. Before acting, Tester must confirm current law, controlling authority, Attorney General guidance, prosecutor direction, agency policy, and the specific facts, and consult an appropriate supervisor, legal advisor, or other authority when warranted.
6. Beta activity, retention, inspection, and feedback
All information Tester enters into Ask PCAT, including questions, prompts, comments, and feedback, will be retained by PCAT and may be inspected by authorized PCAT personnel for quality control, security, beta evaluation, testing, cost monitoring, administration, and improvement. PCAT may also record responses, source references, usage, account information, and technical events. Tester permits PCAT to use feedback and suggestions to improve its products and services without compensation or attribution. PCAT will not identify Tester publicly without permission.
7. Ownership and limited access
PCAT retains all rights in Ask PCAT, its training materials, source organization, branding, methods, software, and beta materials. This Agreement provides only a temporary, revocable, non-transferable right to use the beta as authorized and transfers no ownership or other license.
8. Duration and end of access
This Agreement begins when Tester accepts it. PCAT may suspend or end beta access at any time. Tester’s confidentiality obligations continue until PCAT publicly releases the applicable information and do not end merely because Tester’s beta access ends. Information that remains non-public—including PCAT training materials, source collections, security information, proprietary methods, and trade secrets—must continue to be kept confidential for as long as it remains non-public or legally protected.
9. Required disclosure
If legally required to disclose Confidential Information, Tester will, to the extent legally permitted, promptly notify PCAT and disclose only the information legally required.
10. No warranty; beta availability
The beta is provided for evaluation on an “as is” and “as available” basis. Features may change, fail, or become unavailable. To the extent permitted by law, PCAT makes no promise that beta responses will be complete, current, or error-free.
11. General terms
New Jersey law governs. If any provision is unenforceable, the remaining provisions remain effective. This is the complete agreement concerning this beta’s confidentiality and responsible use and may be changed only in writing. Electronic acceptance, including a typed name and recorded acceptance through Ask PCAT, is intended to have the same effect as a handwritten signature.
